Background
Section 2 of the Law Reform
and Development Commission Act, 29 of 1991, as amended by the Law Reform and
Development Commission Amendment Act No. 2 of 2004, provides that “there is
hereby established a body to be known as the Law Reform and Development
Commission.” This body since its establishment on 15 July 1992 is evidently
the Law Reform and Development Commission (LRDC). Being a creature of statute,
the Commission’s independence is limited, as the Minister of Justice is still
empowered to approve the Commission’s programmes. Financially the Commission is
solely dependent on funds appropriated by Parliament for that purpose.
